Agreement
These Terms govern your access to and use of Erphele - the web, desktop, and mobile apps and related services. By using Erphele, you agree to these Terms. If you don't agree, please don't use Erphele.
Who you're contracting with
Erphele is an independent product operated by a licensed self-employed software professional based in the Kingdom of Saudi Arabia. Your agreement is with that operator (“Erphele”, “we”, “us”). Our registered business details, including the operator's legal name and licence number, are filed with Apple, Google, and Polar, and we will provide them on request at support@erphele.com. Paid subscriptions are sold by Polar as merchant of record, so your purchase contract for the subscription itself is with Polar; everything else on this page is between you and us.
The service
Erphele is a personal productivity agent: it manages your tasks, projects, and calendar; chats with you; generates files and hosted sites; remembers context across days; can act proactively on your behalf; and, if you enable it, can work on your own computer through the desktop app. Features may change as we improve the product.
Your account
You sign in with Google, with Apple, or with a one-time code sent to your email, handled by our authentication provider (Clerk). You are responsible for activity under your account and for keeping your sign-in method secure. You must be at least 13 years old to use Erphele.
Acceptable use
You agree not to use Erphele to:
• break the law or infringe others' rights; • send spam or abusive content; • attempt to disrupt, reverse-engineer, or gain unauthorized access to the service; • host malware, phishing, or illegal content on Erphele-hosted sites; • publish agents designed to manipulate, harm, or extract data from the people who install them; or • abuse the AI to generate harmful or prohibited content.
We may remove content or suspend accounts that violate these Terms.
AI output
Erphele uses AI models that can be wrong, incomplete, or out of date. Output is provided “as is” for your judgment - verify anything important before relying on it, especially for legal, financial, medical, or safety-critical decisions. You are responsible for actions you take based on Erphele's output.
Your content & ownership
You own the content you create with Erphele. You grant us the limited license needed to store, process, and display that content to operate the service for you (including sending it to our AI and infrastructure providers). We don't claim ownership of your content, and we never use it to train AI models - see “Connect your own AI account” for what changes when you deliberately route requests to a provider account of your own.
Hosted sites
Erphele can publish sites for you at a public URL on erphele.site - a domain kept deliberately separate from the app. Anything you publish is visible to anyone with the link, and you are responsible for it: it must comply with these Terms and applicable law. If your site collects information from visitors (for example, through a form), those submissions are delivered to you, and you are responsible for handling that data lawfully and honestly. We may take down sites that are abusive, illegal, or violate others' rights, and anyone can report a site to us.
Computer Use
The desktop app can let the agent work directly on your computer: reading and writing files in your home folder, running command-line tools, and - with your explicit approval each time - installing software or fetching from the internet. This only works on a device you have paired with a code shown on that device's own screen plus a fresh identity check, and you can revoke a device or switch the feature off entirely at any time.
You are responsible for the commands you approve and for what they do on your machine. Routine read-only commands may run under a standing grant you control; everything with side effects asks first, and dangerous commands are blocked outright. Erphele records each command and its output so you can always see what happened. Because your machine and its software are yours, Computer Use is provided “as is” - review what you approve.
Agent marketplace
You can publish an agent you've built to the community marketplace, and install agents published by others. Publishing shares the agent's name, role, description, personality, instructions, avatar, and your display name - publicly. It never includes your memories, chats, notes, or tasks. By publishing, you grant other users the right to install and use copies of your agent; withdrawing a listing stops new installs but does not remove copies already installed. Submissions go through an automated safety review before they appear, and installed agents start with a completely fresh memory in the installer's own account.
Connect your own AI account
Paid plans let you run replies on your own OpenAI account instead of ours, in one of two ways: an API key you connect (requests go to OpenAI's API), or your ChatGPT subscription (requests go to OpenAI's ChatGPT backend on your own plan). A key you connect is verified, encrypted at rest, used only for your requests, and revoked and deleted when you disconnect it or delete your account. The Connect plan includes no Erphele-funded AI usage - it exists specifically for running on your own account.
Traffic on a connected account is governed by your agreement with OpenAI, not by ours: its usage terms, its retention, and its model-training settings all apply, and you administer them in that account. Consumer ChatGPT accounts permit training on your conversations unless you turn it off there. Erphele's commitment that we never train on your content, and never hand it to anyone else to train on, covers the processing Erphele funds and controls. Usage on your own account is billed to you by your provider, separately from your Erphele subscription. Temporary chats never run on a connected account.
Subscriptions & billing
Erphele offers a free plan and paid plans (Connect, Pro, and Max). Paid subscriptions are handled by Polar as merchant of record and renew automatically until cancelled. You can cancel anytime; access continues through the end of the paid period. Plan limits and pricing are shown in the app and may change with notice. We don't offer free trials of paid plans.
Prices are in US dollars. Because Polar is the merchant of record, it calculates and collects any sales tax or VAT due in your country: in most of the world the price you see already includes it, while in places where prices are quoted before tax - the United States, Canada, and India among them - the tax is added at checkout. The exact total is always shown before you pay.
Fair-use compute allowance. The quotas listed for a plan are upper bounds, not guarantees to be spent all at once: every paid plan also carries a monthly fair-use allowance for the AI compute your account consumes, sized generously so ordinary personal use never reaches it. As you approach it, Erphele shifts to lighter processing for the rest of the month - shorter reasoning, core tools only, and no proactive work. If you reach it, Erphele-funded replies pause until your next monthly period; a connected AI account of your own keeps working, because the allowance bounds what we spend, not what you do. Sustained automated or resale-scale use is not personal use, and we may contact you or restrict the account.
If a payment fails. Polar retries a failed renewal for a limited period, and your account keeps its plan and its chat access throughout. The paid add-on allowances - file generation, web searches, image analysis and generation, voice, speech, proactive work and scheduling - drop to free-plan levels until a payment succeeds, and return the moment it does.
Refunds & cancellation. Cancel at any time from the customer portal Polar provides, or from Settings. Because Polar is the merchant of record, refunds are requested from Polar - email support@erphele.com and we'll help you raise it. Outside a statutory right, paid periods already started are non-refundable. If you're a consumer in the EU, EEA, or United Kingdom you have a 14-day right of withdrawal on a digital subscription. Erphele is made available to you immediately on purchase, and by subscribing you ask for that immediate performance and acknowledge that your withdrawal right ends once the service has been fully supplied - for the part already supplied, a withdrawal within the 14 days is refunded pro rata.
Termination
You may stop using Erphele and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service and its users.
Disclaimers
Erphele is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We don't guarantee the service will be uninterrupted, error-free, or that AI output will be accurate.
Limitation of liability
To the fullest extent permitted by law, Erphele and its operators are not liable for indirect, incidental, or consequential damages, or for any loss of data or profits arising from your use of the service - including changes made to your own devices through commands you approved.
Governing law & disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia, and the courts there have jurisdiction over any dispute arising from them. If you use Erphele as a consumer, this does not take away the protections of the mandatory consumer law of the country you live in, and you may bring a claim before your local courts. Disputes about a charge are usually fastest through Polar, the merchant of record for subscriptions.
Before going to court, please email support@erphele.com and give us 30 days to resolve it - most problems end there. Claims are brought individually; there are no class or representative proceedings, where that limit is permitted by law.
Severability & the whole agreement
If any part of these Terms is held unenforceable, the rest stays in force and that part is narrowed only as far as needed. Not enforcing a term once doesn't waive it. These Terms, together with our Privacy Policy, are the whole agreement between you and us about Erphele. You may not transfer them; we may transfer them to a successor operating Erphele.
Changes
We may update these Terms as Erphele evolves. Material changes will be reflected by the “Last updated” date above, and continued use after changes means you accept them.
